What an FDA warning letter is

A warning letter is FDA’s principal advisory notice that a company has significant violations of FDA requirements. FDA’s Regulatory Procedures Manual describes it this way: “A Warning Letter is informal and advisory,” and “Warning Letters are issued to achieve voluntary compliance and to establish prior notice.” Significant violations are “those violations that may lead to enforcement action if not promptly and adequately corrected” (FDA Regulatory Procedures Manual, Chapter 4).

Informal does not mean minor. Warning letters are published on FDA’s website, can trigger import alerts, hold up pending applications and attract attention from customers and investors. If violations are not corrected, FDA can move to seizure, injunction or civil money penalties.

How a warning letter differs from a Form 483

A sharp rise in 2025. CDER warning letters rose 50% in fiscal year 2025, which CDER’s compliance director called a “very significant increase” (RAPS). Law firm Reed Smith counted that “Between July 1 and December 3, 2025, the agency issued 327 warning letters,” 73% more than the same period in 2024 (Reed Smith). For devices, Emergo by UL counted 54 CDRH warning letters in 2025, up from 43 in 2024 (Emergo by UL).

Sustained pressure in 2026. Epstein Becker Green noted at mid-year that “the volume and breadth of these letters signal sustained enforcement, not a one-time sweep,” including continued letters on compounded GLP-1 marketing and cGMP letters to foreign sites (Epstein Becker Green).

The first warning letter on AI misuse. In April 2026, FDA cited a drug manufacturer for “Inappropriate Use of Artificial Intelligence in Pharmaceutical Manufacturing.” The letter states: “If you use AI as an aid in document creation, you must review the AI generated documents to ensure they were accurate,” and “any output or recommendations from an AI agent must be reviewed and cleared by an authorized human representative” (FDA warning letter, Apr 2, 2026). RAPS reported the violation was cited under 21 CFR 211.22(c), the quality unit’s responsibilities (RAPS).

The first QMSR warning letters. For device makers, the first warning letters under the Quality Management System Regulation, issued in May and July 2026, cited ISO 13485 clause 7.1 on risk management and clause 7.3.9 on design changes. One found a risk procedure that “does not define how risk management activities are performed and documented” (FDA Law Blog).

More targeted inspections. FDA conducted “more than 17,000 domestic and international inspections” in FY2025 and has sharply increased unannounced inspections in India and China (FDA). FDA also uses its generative AI tool Elsa to “identify high-priority inspection targets” (FDA).

Common triggers

  • Inadequate 483 responses, especially those without root cause, scope assessment or evidence
  • Quality unit failures, such as unclear authority or missing procedures (21 CFR 211.22 for drugs)
  • Investigation and CAPA weaknesses, including repeat findings
  • Data integrity problems, such as unreliable or unattributable records
  • Risk management and design control gaps for devices under the QMSR
  • Unapproved products or misleading claims, a large share of CDER letters in FY2025
  • Uncontrolled use of AI in GMP documentation, as the April 2026 letter shows

How to respond to a warning letter

  1. Read it as a system finding. FDA usually cites examples; it expects you to fix the system that allowed them.
  2. Respond within 15 working days, as letters typically request (FDA RPM). If actions take longer, explain the timeline.
  3. Show a global assessment of other products, sites and data affected.
  4. Give root causes supported by evidence, not assumptions.
  5. Provide objective evidence for completed actions and a dated plan for the rest.
  6. Address the quality system and management oversight, not only individual documents.
  7. Consider independent support such as a qualified consultant for data integrity or remediation when the findings are systemic.
  8. Send updates until all commitments are complete.

Getting to a close-out letter

FDA can issue a close-out letter after it verifies corrective actions, usually through a follow-up inspection. FDA is explicit that a close-out “will not be issued based on representations that some action will or has been taken” (FDA). Evidence, not promises, closes a warning letter.

Warning letter response checklist

  • Response team assembled with QA, operations, regulatory and counsel
  • Each violation addressed with a global scope assessment
  • Root causes supported by data
  • Completed actions backed by objective evidence
  • Remaining actions with owners and dates
  • Systemic quality system and management oversight changes described
  • AI use in GMP documents reviewed and controlled by qualified people
  • Response submitted within 15 working days
  • Regular updates scheduled until completion
  • Readiness for follow-up inspection confirmed

Review your response with cited evidence

A warning letter response is judged on whether it is complete, specific and supported. AI document assessment can review a draft response against each cited violation, flag gaps in scope, root cause or evidence, and cite the passage behind every finding. Following FDA’s own expectation, qualified people review every output and make the decisions.

Are warning letters public? Yes. FDA posts them on its website.

How long do I have to respond? Letters typically request a response within 15 working days.

Has FDA issued warning letters about AI? Yes. An April 2026 letter cited inappropriate use of AI in pharmaceutical manufacturing documentation (FDA).
